I. If the client decides to cancel the event of this contract, then the deposit is forfeited to ArizonaWeddingMusic.com LLC, and ArizonaWeddingMusic.com is deemed to have fulfilled the obligation under this agreement.
II. The client also agrees to pay the full BALANCE of 72 hours prior to the event. The client’s failure or refusal to pay the above stated compensation to ArizonaWeddingMusic.com, or its legal representative assigned to perform at the event, shall release ArizonaWeddingMusic.com from providing and remaining services to the client under the agreement. Refusal to perform under such circumstances shall not constitute breach of contract by ArizonaWeddingMusic.com and its performers whether such unpaid claim shall be made in whole or part.
III. Additional performance time will be charged at a rate of $100 per hour over and above the quoted price.
IV. The client hereby agrees to pay all costs of collection, including attorney fees, to ArizonaWeddingMusic.com if legal action is instituted by ArizonaWeddingMusic.com against the client for breach of client’s responsibilities under this agreement.
V. The agreement by ArizonaWeddingMusic.com to perform on the date of the event is subject to reasonable and good faith detention by the assigned performer’s accident, Acts of God, or any other legitimate conditions beyond the control of ArizonaWeddingMusic.com and its performers. If the assigned performer(s) is unable to perform at this event, the choice of a replacement for performing personnel will be exclusively under the control of ArizonaWeddingMusic.com. Should a performer be prevented from performing, once at the event, due to circumstances beyond his/her control (i.e. power failure, schedule conflicts with the reception site, strikes, Acts of God, or any other legitimate conditions beyond the control of ArizonaWeddingMusic.com and its performers), the performer and/or ArizonaWeddingMusic.com shall not be held responsible and will be deemed to have fulfilled his/her obligation under this agreement.
VI. If the ArizonaWeddingMusic.com performer(s) should fail to perform at the event for circumstances not beyond his/her control, this shall constitute a breach of contract and shall subject ArizonaWeddingMusic.com to direct liability in damages to the client for the contracted price of the missed event. This remedy shall constitute the maximum limit of ArizonaWeddingMusic.com’s liability under any circumstances.
VII. ArizonaWeddingMusic.com reserves the right to terminate all services during the event if for any reason the performer(s) feel they are threatened in any way, shape or form, or due to any activities that may arise during the event that may place the performer(s) in any danger.
VIII. The client agrees to be responsible for any damages to ArizonaWeddingMusic.com’s equipment directly resulting from actions at the event which otherwise would not have occurred had services not been contracted for.
IX. The client agrees to provide suitable refuge for ArizonaWeddingMusic.com and its performer(s) if the event is to be held outdoors. The client understands that there may be high voltage electrical equipment being operated during the event and that it is dangerous and harmful to operate such equipment during inclement weather. Arizona Wedding Music.com shall make the decision to turn off all equipment and power during inclement weather to prevent any injury to the guests or the associates of ArizonaWeddingMusic.com or its equipment.
X. The agreement shall be governed in accordance with the laws of the State of Arizona, USA. If any provision of this agreement is held to be invalid under the law, the other provisions continue in force.
